In the name of God Amen-
I Charles Hinson of the County of Anson and State of North Carolina being of sound mind and perfect memory Blessed be God for the same and calling to mind the mortality of the body (knowing) that it is appointed to all men once to die and after this to Judgement do this the tenth day of May in the year of our Lord one thousand eight hundred and forty seven do make and ordain this my last will and Testament in the following form and manner and first of all

I give and bequeath to my beloved daughter Nancy Hailey (wife of Charles Hailey) the following property two beds bedsteads & furniture one beaufat(?) and part of the furniture contained there in one chest of drawers and bookcase and all my books one clock one looking glass two charts one arm chair and two sitting chairs and all the balance of the household furniture

I give to the said Nancy Hailey to her and her heirs forever and fourth said Nancy Hailey to decide the above named property among her heirs at her own discretion

I also give to the said Nancy Hailey one weaving loom & gear belonging thereto and all the balance of the kitchen furniture to her and to her heirs former and secondly - my two mares one oxen & cart and all my stock of cattle hogs and sheep (except one cow and calf I changed with Nancy Hailey previous to the making of the will) together with my farming utensils and my present crop now growing all the above named property in the second clause I wish sold and the moneys arising there from applied to the payment of my small debts it is further my desire that my creditors let the above named property to stay on the plantation until the crop be housed and should there be a surplus of money after paying the above small debts I wish it to be equally divided among my three grand children Ira Hailey, Wesley Hailey and Charles Hailey-

Item 3rd I also give and bequeath to my daughter Nancy Hailey my negro boy named Jack (provided my Executor can so arrange the matter with Joseph Medley who has at this time a lean on sd negro boy) to go to her and her heirs forever wishing the above may be so arranged as not to part sd negro boy from his family -

And 3rd I give and bequeath to my daughter Nancy Hailey and it is further my wish and desire that the place where on I now live to belong to the said Nancy Hailey (provided my Executor can so arrange the matter with Joseph Medley who has at this time a lean(sic) on Property) to go to her and her heirs forever -

4th And whereas there is fifty acres of land inside of my boundries claimed by John C. Hinson I wish it distinctly understood that I claim that as my distribution share of the lands that I fell to them the said John C. Hinson & Ursulas Howard by virtue of my first wife (for the raising of them also for board and tuition) my wish is that the said fifty acres of land be sold with my this lands and the money arising there from be applied to the payment of the Judgement now in the hands of Joseph Medley -

5th Item Showing that I have already given to my son John C. Hinson fourteen hundred & seventy four dollars and five cents worth of property of which there was one hundred acres of land of my first wifes property valued at seven hundred dollars the balance of the fourteen hundred & seventy dollars & five cents was of my own property -

6th Item Showing that I have already given to my daughter Ursulas Howard seven hundred dollars worth of property (it being a negro by name of Legs) which came to me by virtue of my first wife valued at seven huindred dollars. The hundred acres of land standing to John C. Hinson was relinquished by me to Ursulas Howard and the negro boy Standing to Ursulas Howard was given by me to John C. Hinson but the change above was made by themselves

7th Item showing that I have already given to my daughter Katharine Vaughan more than all the rest of my children in different kinds of property -

8th Showing that I have already given to my granddaughter Mary Jane Ratliff three hundred dollars in different kinds of property -

9th Item it's my wish and desire that if the arrangement be made between my Executor & Joseph Medley concerning the negro boy named in the 3rd item that the sd negro boy shall be the property of Nancy Hailey until my Grandson Charles Hailey arrives to the age of eight years (or sooner if my Executor sees proper)or at which time I wish his worth equally divided among my three grandchildren Ira Hailey, Wesley Hailey & Charles Hailey but should Ira or Wesley die without lawful heirs I wish their shares to go to my grandson Charles Hailey and should the said Charles Hailey die without lawful heirs I wish his share to go to the heirs of Nancy Hailey that may be born hereafter but should there be more born here after I wish his to go to her present heirs each to share & share alike

Lastly I hereby nominate constitute and appoint my son-in-law Charles Hailey sole Executor of this my last will and testament hereby revoking and making void all former wills by me made declaring (as the Testator) this to be my last will & testament in the presence of the witnesses together with the testator who were all present at the signing and sealing thereof signed sealed published and declared by the said testator as his last will and testament day and date first written
