State of North Carolina. To all persons to whom these presents shall come. [Greeting?]
Joseph White high sheriff of the county of Anson [?] Whereas by writ of [?] [?]
as [issued?] out of the superior court of the County of Anson hearing [test?] the second
Monday September AD, 1843 and the said sheriff directed he was commanded that of the
[good?] & [chattely?] and indefault thereof of the lands and tenements of John
Permenter and Elisha Permenter if to be found in his county he should cause to be made
the sum of eighty two dollars and forty seven cents with interest on [thirty?] five
dollars & forty eight cents from the 15th of September 1841until paid in discharge of
a judgement obtained by John Taylor against John Permenter & Elisha Permenter at
September court 1843 for the sum of one hundred sixty four dollars and 94 cents and
which when [?] [?] adjudged the said John Taylor for his debt and damages and the sum
of two dollars and 45 cents for his cost in said suit exprended and also the sum of
one hundred thirty nine dollars and ten cents and interest on one hundred dollars
from the 15th September 1841 until paid in discharge of a judgement of [two?]
hundred & seventy eight dollars & twenty cents obtained by Mark Hailey against the
said John & Elisha Permenter at September 1843 of Anson Superior Court which where then
and there adjudged to the said Mark Hailey for his debt and damages and also the further
sum of three dollars & forty five cents for his costs and charges in said suit expended
whereof the said John Permenter & Elisha Permenter were liable as appears of record
and that he should have said money before the said court opn the second Monday of
September AD 1844 then next [ensuing?] then and there to render to the said John Taylor
& Mark Hailey by the said money for their said debts damages & costs & that he should
have then & there [thore?] [writs?] and whereas the said sheriff did on that day return
to the said court that by virtue of the said writs to him directed he had served and
taken in execution a certain parcel of land lying and being in the county of Anson on
Pee Dee river adjoining Amos [Liles?] & James Permenter beginning at a stake the [?] corner
of lot No [8?] in the division of the land of James Permenter [?] [?] [?] with the
line of No. 3 So. 18 Et. [6?] chains & 60 links to a stake by 2 [pines?] [?] thence
No 65 Et 65 chains along an unmarked line to a wild locust on the river bank then up the
river six chains & 60 links to an ash on the river bank a corner of No 5 then with
sadi line So 65 Wt 65 chains to the beginning containing forty three acres also
Elisha Permenters undivided interest in four hundred acres adjoining a [?] David Huntly
[Saul?] Gaddy & others on the waters of Jones creek and whereas the said sheriff having
given due notice of the time and place of sale of said of the said land did on Tuesday
the 12th day of March AD 1844 expose the same to public sale by public [venue?]
or [oral?] [?] & sold the same to Mark Hailey and Reuben Hailey for the sum of ten dollars
they being the highest bidder and that the highest and best price bidden for the same
Now know ye that the said sheriff for & in consideration of the aforesaid sum of ten
dollars to him in hand paid by the said Mark Hailey and Reuben Hailey at or before the
sealing & delivery of these presents the receipt whereof he doth hereby acknowledge
hath given granted bargained & sold and by these presents doth give grant bargain &
sell according to the direction of the said recited writs & by force and virtue thereof
unto the said Mark Hailey & Reuben Hailey theirs heirs & afsigns all the said above
described lands & tenements together with all & singular the buildings improvements
rights [?] & appurtenances whatsoever thereunto belonging or in any wise appertaining
& the revision & remainders rents [?] & profits thereof and also all the estate rights
titles interest claim or demand of the said Elisha Permenter of in to or out of the
same parcels of land to have and to hold the said lands tenements heredetaments
& premises hereby granted with the appurtenances unto the said Mark Hailey & Reuben
Hailey their heirs & afsigns to their own proper use and behalf forever for such rents
condirions & limitations as the said Elisha Permenter had and held the same at and
immediately before the taking thereof in execution for no other or greater estate than
the said Elisha Permenter then & there held the same according to the form and affects
of the laws & usuages of the state of North Carolina in such case made and provided.
